TERMS AND CONDITIONS FOR USING CREDIMAX CARDS IN CONTACTLESS TRANSACTIONS THROUGH THE DIGITAL WALLET  

These terms and conditions shall govern your access to and use of your Card in contactless transactions through the Digital Wallet, and shall form a binding agreement between you and CrediMax B.S.C (Terms and Condition of Use).

By proceeding to enroll your Card in the Digital Wallet, and by using your Card through the Digital Wallet, these terms and conditions will automatically apply to you, and you agree to be bound by these Terms and Condition of Use. If you do not agree to these Terms, you should immediately terminate the use of your Card at the Digital Wallet. 

1, DEFINITIONS

CrediMax or We or Us means CrediMax B.S.C. (c).

Cardholder or You or Your means the Cardholder of a CrediMax’ s issued credit card.

Card means selected credit cards issued by CrediMax which are eligible the Contactless feature and for enrolment in the Digital Wallet.

Contactless means the technology through which a Card with an embedded Radio Frequency Identification (RFID) chip and an antenna transmits payment details wirelessly to a contactless reader connected to a merchant’s point-of-sale (POS) system.

Device means an electronic device such as a computer, smart phone, tablet, smart watch or other such device, which is compatible for use of the Wallet solution, which CrediMax determines, is eligible for the registration of CrediMax to be used in the Digital Wallet.

Digital Wallet means an application of a Device that allows you to enroll your Card and use your Card to make Contactless payments through such Device rather than transacting with your physical Card.

Digital Wallet Provider means technology provider (CrediMax) who owns the Digital Wallet, agents and affiliates.

Passcode means your user ID, login password and finger print(s) which are required to access your Digital Wallet.

2, Terms and Conditions Applicable

2.1 These Terms and Condition of Use, are in additional to, and must be read together with the prevailing terms applicable to your Card with CrediMax, including the:

  • CrediMax Cards Terms & Conditions
  • CrediMax Service and Fees Guide

(Collectively, the Relevant Terms and Conditions).

2.1 CrediMax reserve the right, without prior notice to you, to change and amend the Terms and Condition of Use by updating the same on CrediMax website. You shall be bound by such changes and amendments and should therefore review the current Terms and Conditions of Use as posted on CrediMax website from time to time. The Cardholder accepts and understands that it is his/her responsibility to refer to the updated Terms of Use on the CrediMax website on www.credimax.com.bh

3. ENROLLMENT AND ELIGIBILITY OF THE CARD FOR CONTACTLESS TRANSACTIONS THROUGH THE DIGITAL WALLET

3.1 To enroll a Card, please follow the enrollment instructions set out in the Digital Wallet. Enrollment of a Card and using the same shall be subject to CrediMax acceptance.

3.2 CrediMax reserve the right to determine which Card is eligible for use through the Digital Wallet and to carry out Contactless transactions. CrediMax may decline any enrollment of a Card to a Digital Wallet without having to provide any reasons or justification. If you hold multiple Cards, an enrollment of a Card does not mean that your other Cards will be automatically allowed to be enrolled to the Digital Wallet.

3.3 Any applicable interest, fees, and charges that apply to your Card will also apply upon usage of the Card through the Digital Wallet. CrediMax does not impose any additional charges for use of your Card in Contactless transactions through the Digital Wallet. The Cardholder shall be solely responsible of any charges imposed by the Wallet Provider and/or other third parties, such as, telecommunications or wireless providers or data service providers, which may levy web-enablement, data usage, and text messaging fees or other charges for use of the Digital Wallet.

3.4 Any limits CrediMax place on the frequency of your Card transactions will also apply to Contactless transactions through the Digital Wallet.

3.5 CrediMax reserve the right, without prior notice to you, to change, to terminate, to suspend or modify the type of transactions; or cap amount; or transactions limit; allowed by using the Card through the Digital Wallet, or with respect to the Contactless feature of the Card, or to change a Card’s eligibility for use through the Digital Wallet, or to change the Card authentication process.

4. USE OF THE CARD IN CONTACLESS TRANSACTIONS THROUGH THE DIGITAL WALLET

4.1 By enrolling a Card to the relevant Digital Wallet, the Cardholder will be allowed to conduct Contactless transactions at merchants who hold a card acceptance device bearing the mark contactless, whether inside or outside the Kingdom of Bahrain.

4.2For conducting the Contactless transaction, the Cardholder must hold the Device at a short distance from the special censor of the contactless point of sale device of the merchant, once the transaction is identified and appears on the screen of the Device, the Cardholder must type the Card’s PIN number on the merchant’s device.

4.3Apart from the above, The Cardholder may not conduct any other kind of Contactless transaction through the Digital Wallet, such as, cash withdrawal from ATMs or branches.

4.4 The Cardholder may delete his/her Card from the Digital Wallet at any time, by logging into the Digital Wallet and removing all the Cards enrolled therein or by contacting CrediMax customer service line on [ 17117117 ]. You may still continue to use your physical Card for transactions and purchases other than through the Digital Wallet, provided your Card account with us is valid and in good standing.

4.5 For security reasons, from time to time the Cardholder may be asked to re-enroll your Card to the Digital Wallet. If you delay or if you do not do so upon such request, you will not able to use you Card for any purchase through the Digital Wallet.

4.6 CrediMax reserve the right to refuse the authorization or permit of any Contactless transaction should it suspects a breach of the Terms and Conditions of Use or the Relevant Terms, or that fraudulent or illegal activity is suspected, or committed or will be committed.

4.7 Any payment requisition received from a merchant for payment shall be conclusive proof that the payment recorded on such requisition was authorized and properly and legally incurred at the merchant by the Cardholder.

5. CARDHOLDER RESPONSIBILITIES

5.1 The Cardholder shall ensure to comply with the Terms and Conditions of Use, the Relevant Terms, and the any other terms and conditions, laws and regulations applicable in connection with the use of the Card through the Digital Wallet. The Cardholder shall not encourage, induce, solicit or promote, any conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law or regulation.

5.2 The Cardholder agree not to carry out or refrain from carrying out any action or otherwise use any device, software or routine to interfere or attempt to interfere with the proper working of the Card or the Digital Wallet, including circumventing or attempting to circumvent any user authentication or security measures that have been put in place in this respect.

5.3 The Cardholder acknowledge that all information provided to CrediMax upon enrollment and as may be requested by CrediMax and / or the Digital Wallet Provider, are accurate, complete and updated information, and no misrepresentation has been made by the Cardholder. You must immediately notify CrediMax in the event of any change in the information provided.

6. LOST OR THEFT OF THE DEVICE AND UNAUTHORIZED TRANSACTIONS

6.1 The Cardholder is responsible for keeping the Device lock, PIN, Passcode, and other means to access the Wallet, Card credentials, or any other personal and payment information confidential and preventing fraudulent or unauthorized usage of his/her Card through the Digital Wallet or Device.

6.2 The Cardholder must notify CrediMax immediately and without any delay should the Cardholder suspect or come to realize that the Card or Device has been lost or stolen; or that there has been unauthorized use or access to the Card, Passcode or Digital Wallet or that there is an unauthorized transactions concluded or about to be concluded.

6.3 The Cardholder shall be fully and solely responsible for and bear all charges, costs, losses, and damages whatsoever and howsoever arising from transactions concluded on the Card through the Digital Wallet and which are effected after loss, theft of the Device, unauthorized use or access of the Card or the Passcode or the Digital Wallet or the Device; or after the unauthorized disclosure of the Passcode to third parties.

6.4 Without prejudice to the generality of the above, your liability for the disputed transaction shall be subject to the Relevant Terms and Conditions, as listed above.

7. TERMINATION OR SUSPENSION OF USE OF THE CARD THROUGH THE DIGITAL WALLET

7.1 CrediMax may suspend, discontinue or terminate the Cardholder’s access and use of the Card through the Digital Wallet;  or of the Contactless feature of the Card,  at any time, immediately and without prior notice to the Cardholder, in any of the following events :

  • for objective security and safety reasons, if the Cardholder is suspected for conducting fraudulent transactions or/and committing or upon suspicion of committing money laundering and terrorist financing or any other illegal actions; or
  • in any case the Cardholder breaches any of these Terms; or
  • Reasons listed in the Relevant Terms and Conditions as listed above.
  • for any other reason, upon CrediMax discretion

7.2 The Cardholder agrees that CrediMax shall not be held liable for any damages or losses resulted from any suspension, discontinuance, termination, change or modification of the use of the Card through the Digital Wallet or the Contactless feature of the Card in accordance with this Clause.

7.3 Upon suspension, discontinuance, termination, for any reasons, the Cardholder shall remain liable for all transaction made and other obligations that the Cardholder has undertaken under the Terms and Conditions of Use and the Relevant Terms.

8. PRIVACY AND USE OF DATA

8.1 CrediMax shall collect, store, copy, process, transfer in and outside of Bahrain and use all technical, transactional, location or other general or sensitive and / or personal non-public information provided to CrediMax about the Cardholder and the use of the Card through the Digital Wallet (the Cardholder’s Data), in compliance with all applicable laws, rules and regulations relating to privacy and data protection.

8.2 Without prejudice to the generality of the above, the Cardholder authorizes CrediMax to transmit and disclose his/her Data to:

  • The regulators and formal authorities CrediMax is subject to.
  • The Digital Wallet Provider, its sub-contractors, agents and affiliates and where required, their regulators and authorities.
  • The relevant payment network stated on your Card and the payment network’s sub-contractors, agents and affiliates and where required, their regulators and authorities.

8.3 CrediMax will also make certain account and transactional information relating to each enrolled Card available for display on your Digital Wallet, and this may include information such as your most recent transactions or other data relating to you and / or the enrolled Card. Where applicable, you may be able to customize or decline having such data displayed on your Digital Wallet.

9. LIABILITY AND INDEMNITY 

9.1 CrediMax expressly disclaims all warranties, either expressed or implied, with respect to the Digital Wallet its performance and services, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement, the availability, quality, and accuracy or otherwise of the services provided by the Digital Wallet. CrediMax does not warrant that the Digital Wallet does not contain any malware, malicious or harmful code, or other internal component (e.g. computer viruses, trojan horses, backdoors). No advice or information, whether oral or written, obtained by the Cardholder from CrediMax will create any warranty of any kind.

9.2 CrediMax will not be liable for any losses or damages arising directly or indirectly from or in connection with, for example and without limitation to, any of the following events:

  • Any malfunction or failure of the Digital Wallet services.
  • Any erroneous payments arising out of any inaccurate information provided by the Cardholder as part of processing the relevant transaction through the Digital Wallet.
  • Any unauthorized transactions effected after loss, theft of the Device, unauthorized use or access of the Card or the Device or the Wallet or the Passcode or the unauthorized disclosure of the Passcode for third parties.
  • Any failure or delay in processing and transmission of payments by CrediMax due to reasons beyond its control.

9.3 The Cardholder agree to be liable for all instructions or transactions effected on his/her Card through the Digital Wallet which are posted to the Card account regardless of whether or not the transaction was properly authorized by the Cardholder. All such instructions and transactions are irrevocable and binding on the Cardholder.

9.4 The Cardholder shall indemnify and keep CrediMax fully indemnified against any loss, damage, liability, cost and expense, claims and cases (including legal costs) which CrediMax may suffer or incur arising out of or in connection with the enrollment and use of the Card through the Digital Wallet by the Cardholder or any authorized or unauthorized third party, including without limitation, CrediMax enforcement of the Terms of Use and any other Relevant Terms, breach of any of those Terms, save to the extent such loss arises from CrediMax own gross negligence or fraud or willful default.

10. COMMUNICATION

The Cardholder consent to receive electronic communications and disclosures from CrediMax in connection with his/her Card and the Digital Wallet by email or SMS at any email address or mobile number provided to CrediMax in connection with the Cardholder’s account. The Cardholder agree to update his/her contact information with CrediMax when it changes.

11. WAIVER

No right or remedy shall be precluded, waived or impaired by any failure to exercise it, or any delay in exercising it, or any single or partial exercise of it, or any earlier waiver of it (whether in whole or in part), in relation to any other right or remedy (be it of similar or different character).

12. UNTHEORIZED USE AND ASSIGNMENT

The use of the Card through the Digital Wallet is personal to the Cardholder. The Cardholder shall not authorize any third party the use the Card or the Digital Wallet, and shall not assign or transfer any of its rights or obligations under this Terms and Conditions to any other person unless it is agreed by CrediMax in prior in writing.

13. SEVERABILITY

If any term or part of these Terms and Conditions is or becomes illegal, invalid or unenforceable, it shall be treated as being deleted from the Terms and Conditions and it shall not affect the legality, validity or enforceability of any other terms or parts of this Terms and Conditions.

14. Applicable Law and Jurisdiction

These Terms and Conditions, and any transaction concluded under which, shall be governed by and construed in accordance with laws of the Kingdom of Bahrain and any dispute between the parties shall be referred to the courts of Kingdom of Bahrain.
